Write what you mean, share it with the right person, and read each version before you agree. In Writing records the conversation and final wording. Applicable law and the relevant court or regulator determine legal effect.
ACCEPTING THESE TERMS
0plus1 operates the In Writing apps, website, APIs and related services (the “Service”). By creating an account, accessing an invitation or using the Service, you agree to these Terms and our Privacy Policy.
You must be at least 16 and legally able to agree to these Terms. Users below the age of majority where they live need permission from a parent or guardian.
WHAT IN WRITING DOES
The Service lets you write an agreement, invite another person, respond, propose revised wording and keep the full version history. Once both parties agree, the Service locks the current wording and assigns a record number and cryptographic fingerprint.
A final record captures the wording and responses inside the Service. Applicable law and the relevant court or regulator determine its legal status.
OUR ROLE + YOUR JUDGMENT
In Writing provides self-directed communication and record-keeping software. You and the other party choose the wording and make each decision. The Service checks identity through control of an email account. Witnessing, legal review and representation remain your responsibility.
Laws covering contracts, electronic signatures, consumers, employment, housing and family matters vary. Ask an independent professional to advise you on important, high-value, regulated or uncertain matters. Contact the appropriate emergency service for an emergency.
YOUR ACCOUNT
Provide an email address you control and accurate account information. You are responsible for access to your email, devices, sign-in codes, tokens and account. Tell us at [email protected] when you suspect unauthorised access.
One-time codes expire after a short period. Mobile access tokens remain active on a device until logout, revocation or account action. Use your account as yourself and keep access personal. Account transfers and automated access require our written permission.
INVITATIONS + SHARED RECORDS
An invitation link acts as a private credential for one other person until someone claims it. The first eligible account to claim it becomes the second party. Check the recipient before sharing; you are responsible for where you send the link.
Both parties can see the agreement, party information, responses and history. Each change creates a new version and preserves the earlier wording. Read the current version before you agree. A decline records that response and keeps the agreement history available.
YOUR CONTENT + CONDUCT
You keep ownership of wording you submit. You give us a limited, non-exclusive licence to host, encrypt, copy, transmit, display and process it for operating and securing the Service, improving reliability and meeting legal obligations.
The following conduct breaches these Terms:
- breaking the law or another person’s rights;
- harassing, threatening, deceiving, coercing or exploiting someone;
- uploading malware or interfering with Service security;
- probing, scraping or reverse engineering protected systems;
- sharing an invitation with an unintended recipient; or
- fabricating another person’s identity or consent.
We may restrict or remove unlawful or abusive content and suspend accounts when required to protect people or the Service.
PRIVACY + SECURITY
Our Privacy Policy maps how we handle data. Each agreement receives a unique 256-bit data key. A separate deployment master key wraps that key, and authenticated AES-256-GCM encryption protects each version with its agreement and version context.
Authorised parties and the application systems serving them can decrypt agreement wording. This architecture is server-side envelope encryption with authorised application access. Keep your own copy of critical material and treat invitation links as confidential credentials.
FEES + APP STORES
A free account may create five agreements over the life of the account. Agreements you receive and responses you make never count. Premium removes the creation limit, and only an agreement’s creator needs Premium.
Annual Premium renews automatically unless you cancel through Apple or Google before renewal. Cancellation keeps Premium active until the paid period ends. Founding Lifetime is a one-time, non-consumable purchase for Premium access while the Service remains available. The Lifetime offer may stop being sold without removing access already bought.
The purchase screen shows the current local price, billing period and renewal terms before you approve a charge. Apple or Google processes the payment and applies its cancellation and refund rules. Manage or cancel a subscription through the store account used to buy it. Restoring a purchase never transfers it to a different In Writing account.
“Multiple-person agreements — coming soon” describes planned work, not a feature included in the current purchase. Premium currently provides unlimited agreement creation.
OUR SOFTWARE + BRAND
We and our licensors own the Service, design, software, trademarks and materials we provide. These Terms give you a personal, limited, revocable and non-transferable right to use the Service as intended. Ownership of our intellectual property stays with us and our licensors.
AVAILABILITY + TERMINATION
We may change, pause or discontinue parts of the Service to maintain security, meet legal obligations or operate the product. We may suspend access after serious or repeated breaches of these Terms, risk to other users, fraud or security threats. Where practical, we will provide notice and a chance to export or review records.
You may stop using the Service at any time and request account deletion through the process in the Privacy Policy. Another party may continue to rely on a shared final record. Applicable law determines whether we retain or de-identify that record.
WARRANTIES + LIABILITY
Australian Consumer Law and other mandatory rules preserve the rights, guarantees and remedies they give you. Subject to those protections, we provide the Service “as is” and “as available”. Service availability, error rates, security, suitability and the legal effect of an agreement carry the guarantees required by law.
To the maximum extent permitted by law, our liability excludes indirect, incidental, special and consequential loss, lost profits, lost opportunities, and loss arising from agreement wording or another user’s conduct. Our total liability relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event and A$100. Mandatory law sets any additional liability.
CHANGES + GENERAL TERMS
We may update these Terms for product, security, legal or operational reasons. We will post the updated date and give reasonable notice of material changes. Continued use after the change takes effect means you accept the updated Terms. You can end your use and request account deletion through the Privacy Policy.
The laws of Victoria, Australia govern these Terms. Mandatory rights under the laws where you live continue to apply. A term found unenforceable is severed while the rest remains effective. A delay keeps our enforcement rights intact. A transfer by you requires our consent; we may transfer these Terms as part of a business reorganisation or sale.
